Newark Pride Inc. A New Jersey 501(c)(3) Nonprofit Organization
1. Acceptance of Terms By accessing or using the Newark Pride Inc. website (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Site. Newark Pride Inc. reserves the right to update these Terms at any time, and your continued use of the Site following any changes constitutes your acceptance of the revised Terms.
2. About Newark Pride Inc.
Newark Pride Inc. is a New Jersey-based nonprofit organization exempt from federal income tax under Section 501(c)(3) of the Internal Revenue Code. The organization is operated entirely by volunteers. No individual staff member or representative receives compensation for their work on behalf of Newark Pride Inc.
3. Use of the Site
3.1 Permitted Use You may use the Site for lawful, personal, and informational purposes consistent with Newark Pride Inc.’s mission of celebrating and supporting the LGBTQ+ community in Newark, New Jersey, and surrounding areas.
3.2 Prohibited Conduct
You agree not to:

Use automated tools (such as bots, scrapers, or crawlers) to collect data from the Site

4. Intellectual Property
4.1 Ownership
All content on this Site — including but not limited to text, graphics, logos, photographs, event information, and artwork — is the property of Newark Pride Inc. or its respective content contributors, and is protected by applicable copyright, trademark, and intellectual property laws.
4.2 Limited License
Newark Pride Inc. grants you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. This license does not include the right to reproduce, distribute, modify, publicly display, or create derivative works from any Site content without express written permission from Newark Pride Inc.
4.3 User-Submitted Content
If you submit photos, comments, stories, or other content to Newark Pride Inc. through the Site or associated social media channels, you grant Newark Pride Inc. a royalty-free, perpetual, non-exclusive license to use, reproduce, display, and distribute that content in connection with the organization’s activities and mission.
5. Volunteer-Run Organization Disclaimer
Newark Pride Inc. is operated entirely by volunteers who generously donate their time and skills. While we make every effort to keep the Site accurate, up to date, and fully functional, we cannot guarantee uninterrupted availability or the absence of errors. We appreciate your patience and understanding.
6. Donations
6.1 Tax Deductibility
Newark Pride Inc. is a recognized 501(c)(3) nonprofit organization. Donations made through the Site may be tax-deductible to the extent permitted by law. Donors are encouraged to consult a qualified tax advisor regarding the deductibility of their contributions.
6.2 Donation Policy
All donations are final and non-refundable unless Newark Pride Inc. determines, in its sole discretion, that a refund is warranted. Donations are used to support the organization’s events, programming, and operational costs.
6.3 No Goods or Services
Unless expressly stated in connection with a specific donation opportunity, donors receive no goods or services in exchange for their contributions.
7. Event Registrations and Ticketing
Tickets and event registrations purchased through or in connection with the Site are subject to any additional terms presented at the time of purchase. Newark Pride Inc. reserves the right to cancel, postpone, or modify events. In the event of a cancellation by Newark Pride Inc., we will make reasonable efforts to provide refunds or credits as circumstances allow.

The Site may contain links to third-party websites, platforms, or services (including social media, ticketing platforms, and partner organizations). These links are provided for convenience only. Newark Pride Inc. does not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party sites. Your use of third-party sites is at your own risk.

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, NEWARK PRIDE INC. DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NEWARK PRIDE INC. DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEWARK PRIDE INC., ITS OFFICERS, DIRECTORS, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL NEWARK PRIDE INC.’S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU DONATED OR PAID IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
12. Indemnification
You agree to indemnify, defend, and hold harmless Newark Pride Inc. and its volunteers, officers, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any third-party rights.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Essex County, New Jersey.
